The Demise of the 28-Clause Ceasefire Plan for Ukraine: Why Peace Negotiations Continue to Stumble

Europe felt a moment of respite on Monday, as the crisis sparked by the introduction of a new 28-article proposal for achieving ceasefire appeared – temporarily – to have been stabilised. A Washington representative spoke of "substantial progress" after bilateral negotiations in Geneva. On Monday night, Moscow made its response: another massive barrage of rocket attacks on Kyiv.

The Rhythm of Diplomacy and Destruction

The sequence of contrasting events captured the harsh reality of the current period. By day, negotiation efforts are fought: hopeful statements are issued from different nations. Significant resources is allocated on containing specific proposals. By night, Moscow brutally reminds the world that, for them, military action persists as the key method for achieving "resolution".

Nighttime Reality

As Russia's attack unfolded into the early hours of Tuesday, the immediate reality of Ukraine's vulnerability was revealed. Ukraine is equipped to monitor missile launches from Russian territory, a capability enabled by timely intelligence. From observation points, military aircraft that had been scrambled to engage hostile aerial threats roared overhead – sophisticated military planes provided to Ukraine by European allies.

Soon thereafter, Kyiv's air-defence systems activated: multiple launches targeted at a incoming threat. This was a modern interception technology at work, most likely delivered by partner states. Every deployment shakes the surroundings, shaking the windows. The moment of terror quickly gives way to sober acceptance: perhaps the hostile projectile won't strike its target this time, preventing destruction from ruin and additional electricity failures.

Ongoing Risks

Not long after, a heavy machine gun opened up on a aerial vehicle somewhere nearby, part of a mobile-fire group – most likely Western-made equipment. Sadly, the shots failed to hit the enemy aircraft – it maintained course toward its target.

Intermittently, this continued until dawn. Kyiv faced the early updates: several casualties, destruction and utility failures in multiple buildings as a result of the night's assault. As customarily, everyone still maintained normal activities – enduring hostilities. But those 24 hours encapsulated Ukraine's vital need on international aid – a reliance that neighboring countries are clearly incapable to replace in the near term.

Failed Diplomacy

The detailed framework from American leadership sparked intense emotion, debate and profound anxiety – and briefly redirected concern from Ukraine's most significant graft case in years. Yet, we have witnessed similar scenarios, after earlier high-level meetings and international summits.

Every new proposal from US leadership unfolds according to the same pattern: a diplomatic cavalry charge against Ukraine, which Kyiv, with partner nations, effectively counters. They manage the tension but never actually secure success. This cycle will, undoubtedly, continue.

Political Considerations

It is convenient to criticize specific actors of persistently promoting Kremlin's demands. But that does not seem to be the entire situation. US administration functions according to a premise understood by experienced diplomats: you cannot achieve through diplomacy what you have lost on the battlefield. The US administration presumes that it is impossible to pressure the Kremlin to abandon the land that it presently holds in Ukraine's occupied territories.

The challenge is that while recognising this factual reality, US leadership does little to discourage Russia, through words or deeds, from assuming that the status quo will not shift further in its favour in the coming year.

Divergent Views

Therefore, Moscow is certain that time is on his side – that Ukraine and its allies are coming close to fatigue. Their motivation to accept conditions that does not give them the maximum possible gain is close to zero. There may be multiple initiatives to end hostilities, but they will continue as long as Russia's leadership remains completely certain in the outcome.

On the contrary, Ukraine's government believes that Ukraine can still endure, gradually sacrificing people and territory but avoiding a complete military breakdown until conditions improve in its advantage.

Present Conditions

Factually, there are no real preconditions for a armistice. Now, subjective factors are coming into play: personal goals to broker a ceasefire and obtain worldwide acknowledgment, and Ukrainian leadership's twin challenges – on one hand, not to estrange crucial supporters, and on the other, to rally Ukrainians around the national cause against any plan Kyiv finds unacceptable, so that their priority does not switch to domestic problems. And although their objective will now be considerably more difficult after recent developments, it remains very improbable that this will alter their fundamental strategy.

These two forces are driving the talks.

Assessment and Future

It took a only one week to terminate the proposed articles of the latest plan. Assertive and inconsistent approach of the matter by American leadership, resistance by Ukraine and the other European countries, along with soothing efforts of negotiators, and finally, latest revelations, all did their job.

While new proposals based on previous concepts are imminent, Kyiv, London and other allied nations should reach an essential realization: Ukraine and Europe will only be able to fend off negotiation assaults from Washington that are rooted in Kremlin requirements and reflect certain reluctance to change the course of events, if they maintain solidarity and strengthen their defence capabilities at a considerably quicker tempo. If they do, neither political nor armed coercion will be able to overcome them. In the meantime, Ukraine's capacity to defend against evening bombardments will, for the foreseeable future, primarily depend on ongoing international assistance.
